REGULAR MEETING OF THE MAYOR AND BOARD
OF ALDERMEN
OF THE VILLAGE OF FRENCH SETTLEMENT, JANUARY 14, 2009
The Mayor and Board of Aldermen of the Village of French Settlement
met at the Municipal Building on the 14th day of January in regular
session convened.
The meeting was called to order by Mayor Toni Guitrau with the
following members present:

A prayer was offered by Alderman Newell, and the Pledge of Allegiance
was recited by all.
Adoption of Minutes
The motion to adopt the minutes and statement of finances of the
December 10, 2008 regular meeting was made by Alderman Newell
and seconded by Alderman Guitrau. A yea and a nay vote was called
for and resulted as follows:

Reading of Communications:
Mayor Guitrau has received two LMA Resolutions honoring two past
officials, both passed away in 2008: Lee Roy Salassi who was one
of the original French Settlement Aldermen, and Clyde Wheat, Mayor
of French Settlement for 3 years.
Public Comments on Agenda Items: None
Appointments:
Mayor Guitrau recommended Monte Ferguson as Village Clerk/Treasurer.
A motion was made to appoint Monte Ferguson as Village Clerk/Treasurer
by Alderman Guitrau, and seconded by Alderman Miller. A yea and
nay vote was called for and resulted as follows:
Yeas: Newell, Guitrau, Miller

Attorney:
Mayor Guitrau recommended Timothy Pujol as the Village Attorney
with a $5.00 per hour increase per year to a maximum of $100.00
per hour, with the first year starting at $85 per hour, and as
Ad Hoc Magistrate of Mayor's Court to serve on the occasion that
Mayor Guitrau can not serve due to nepotism or absence. A motion
was made to appoint Timothy Pujol as Village Attorney and Ad Hoc
Magistrate by Alderman Miller, and seconded by Alderman Newell.
A yea and nay vote was called for and resulted as follows:

Mayor Pro-Tem:
Alderman Newell said he has great respect for Alderman Miller's
leadership skills, and thinks she will do a fine job as Mayor
Pro-Tem.
A motion was made to appoint Alderman Miller as Mayor Pro-Tem
by Alderman Guitrau, and was seconded by Alderman Newell. A yea
and nay vote was called for and resulted as follows:

Police Report:
Chief Harry Brignac read the police report for the month of December
2009. 53 traffic citations were issued for January's court date,
3 accidents reported, 27 private or confidential calls, 10 trips
to Livingston, 8 for booking prisoners, 2 for court or subpoena.
The monthly mileage for unit 1 was 687.0 with 50.5 gallons of
gas used. For unit 2, the mileage was 2007.0 with 147.0 gallons
of gas used. For unit 3 the mileage was 609.0 with 67.4 gallons
of gas used.
Chief Brignac also stated that on December 26, 2008, from 9 p.m.
to 3 a.m. a total of 269 vehicles were stopped at a check point
set up on Hwy. 16 in front of the French Settlement Municipal
Building. 25 field sobriety tests were done, 4 were charged with
DWI, 1 with possession of cocaine, 9 received a summons for open
container. Chief Brignac read his Annual Police Report, and presented
it to the Mayor and Board of Aldermen.
Chief Brignac expressed his deepest sympathy to the Matherne family
for the loss of their daughter Sharie Matherne York. She was killed
Christmas morning in a head-on collision on Airline Highway in
Ascension Parish. Chief Brignac is looking into a program, with
the assistance of Alderman Guitrau that would help with the problem
of illegal immigrants driving with no insurance, no license and
so forth. Alderman Guitrau has information pertaining to this
program and this will be discussed further at the next regular
monthly meeting. Mayor Guitrau stated that Sharie was her niece,
and daughter of Kurt and Patsy Matherne, of French Settlement.
The media had reported that Sharie was from Mississippi but she
lived in French Settlement all of her life except for approximately
one year.
Mr. Steve Brignac, of St. Francisville, stated that during the
safety check point cars pulled into his tenant's driveway and
blocked it. He requested that Chief Brignac do something about
that next time. Officer Matherne stated that they could park a
police unit in the driveway to prevent that from happening next
time.
Old Business:
Grounds Report:
Mayor Guitrau stated that both the French Settlement Historical
Society's shed and the village's shed were moved today in preparation
for the construction of a new metal storage building which will
house emergency supplies and other equipment.
Road report:
The Mayor reported that none of French Settlement's new roads
have been striped yet. It is difficult for some of our older population
to see at night, thus making it very dangerous for them to drive.
Mayor Guitrau stated she would get back in touch with the Parish
and see if anything could be done to expedite this process, as
she was informed that it would be done only after all parish roads
were completed.
LGAP Grant:
Mayor Guitrau stated that she is almost ready to close the 2007-
2008 LGAP grant. This $25,000.00 paid for replacing the municipal
building's 26 double paned windows, desks, computers, chairs and
fire-proof filing cabinets. She also stated that this type of
grant may become unavailable for the next few years due to the
economy.
USDA Grant Update:
This was the grant received in 2007 totaling $103,500.00 to purchase
2 new police units, the digital sign, and other police equipment.
The mayor met with USDA for one final interview which she believes
may have officially closed the grant.
State Appropriations Update:
Mayor Guitrau stated that the $30,000.00 that we were to receive
from the state has been cut by 5%. We are fortunate to receive
$28,500.00. This money will be used for a new metal storage building
to be located directly behind the town hall building.
New Business:
February Conference:
If the Aldermen attend this conference they should let the clerk
know so she can make arrangements. At the Conference, Chief Brignac
will be part of a round-table discussion with Mayors, and Aldermen.
Purchase of Property Discussion:
The town is looking to purchase property inside village limits
in order to build a community center. The mayor would then apply
for a grant to go toward the construction of the building.
Review Ordinance No. 9 of 1997
This ordinance was passed 11 years ago while Mayor Floyd Younger
was in office. The goal at that time was to pass a Communication
& Tower Ordinance so the town would one day have additional
income from the placement of a communication tower on town property.
However, said Ordinance clearly states that a tower must be a
minimum distance equal to twice the height of the tower from any
structure of historical significance. The Creole House was registered
as an historic place by Mayor Younger on April 3, 1992. Mayor
Guitrau stated that after recently measuring the grounds, there
is no place on this property that can accommodate a 190 foot tower,
so on January 8, 2009 she called and wrote to Verizon and cancelled
the tower. Mayor Guitrau read the letter she wrote to Verizon
on January 8, 2009. She also said that she would not recommend
to the Board that they consider changing the ordinance to suit
the needs of the town in regard to this tower. She did mention
that perhaps later the Aldermen might want to reconsider this
ordinance because there are many homes registered as historic
in French Settlement and this ordinance, as written, could hurt
the possibility of the placement of a tower on someone's private
property.
Mr. Steve Brignac, of St Francisville, asked if this ordinance
applies to private property as well, and Mayor Guitrau replied
that it does.
FS Historical Society Use Agreement
Mayor Guitrau presented the public in attendance with copies of
the Use Agreement prior to 1993, the current 1993 Use Agreement
and the Minutes of 1993. She stressed that it was not the fault
of the FS Historical Society or the current Board of Aldermen
that the FS Historical Society was not carrying liability and
casualty insurance prior to July 2008 as per the Use Agreement.
She stated that in July of 2008 she reviewed the current Use Agreement
and discovered it required the FS Historical Society to pay all
utilities, and to carry liability and casualty insurance. Since
July 2008, Mayor Guitrau requested this Proof of Insurance from
the FS Historical Society. Also, the Special Event Proof of Insurance
requested for the Creole Festival had not been provided to the
town for the October 2008 festival, which is a requirement in
order to hold a festival on town property. Mayor Guitrau said
she felt after waiting 4 months with no results she had no choice
but to contact the town attorney to let him handle the matter.
The town attorney wrote a letter to the FS Historical Society
in mid-December giving them until midnight, December 31, 2008
to provide the town with Proof of Insurance or else they would
be evicted. After they failed to provide the Proof of Insurance
for both the one day festival and the liability and casualty insurance,
he then sent them an eviction notice on January 7, 2009 requiring
them to vacate the premises by January 31, 2009.
Today the mayor received the FS Historical Society's Proof of
Insurance and informed the members of the FS Historical Society
in attendance that she recalled the eviction notice. She said
that the Use Agreement would remain in effect, as is, with the
FS Historical Society using the Creole House free of charge, etc.
However, the town will install a new electric meter on the museum
so that the FS Historical Society or future tenants may pay the
utilities. Last year the FS Historical Society had approached
the Board of Aldermen about allowing them to continuously run
the heat, air and a de-humidifier at the cost of the town. The
Board had said that the town could not afford this expense. Mayor
Guitrau reminded them of this prior request and said that once
the meter is installed and they are paying the utilities, they
can run the electricity as much as they like.
FS Historical Society President, Ms. Kim Aydell, of French Settlement,
spoke before the Mayor, Board of Aldermen and public. She stated
that the reason for the delay in providing the Proof of Insurance
was because she did not see the sense of urgency and did not think
the insurance was a pressing matter, as the FS Historical Society
had been there for some time. Ms. Aydell stated that they are
a small organization and very seldom check their mail and they
did not get the eviction notice until January 2, 2009. She said
that as of today they have the required Proof of Insurance. Ms.
Aydell, the Mayor, and Board of Aldermen agreed that there should
be no verbal agreements altering what is written in a legal Use
Agreement. Aldermen Miller said the sense of urgency belonged
to the town and this is the way it should have been done from
the beginning. Alderman Newell noted that everything from now
on should be in writing. Ms. Aydell said she hoped future problems
could be handled without involving an attorney, and we are one
community and there should be no segregation. The FS Historical
Society is there to continue to preserve history, and the museum,
and is an asset to the community.
Mayor Guitrau agreed that we are one community but we have to
remember that legally we are separate entities. As far as not
involving the town attorney, the mayor stated this would not have
been turned over the town attorney if the Proof of Insurance had
been provided in a timely manner as required. She reminded them
that years ago someone broke an arm at the Creole Festival and
the claim was turned in to the towns insurance. If someone was
hurt while viewing the museum or while at the festival, the town
would be held liable and more than likely would be sued. This
is why the town attorney, back in 1993, drew up the current Use
Agreement to cover these issues. From this day forward, the Proof
of Insurance must be provided annually for the liability and casualty
insurance per the Use Agreement and also the 'special event one
day insurance' for the festival must be provided prior to the
festival.
Alderman Miller stated that another issue to be addressed is
the need for the FS Historical Society to begin paying to rent
the pavilion. In 2002, the Board of Aldermen agreed upon, at the
request of then FS Historical Society President Mercy Lobell,
to allow them to rent the pavilion free of charge. However, as
an organization the FS Historical Society is no different from
any other organization that wishes to rent the pavilion and should
pay as all others do, including elected officials and town staff.
The cost is $75 per day.
There was further discussion on what the liability and casualty
insurance covers. The final discussion ended amicably and with
a better understanding of what must be provided annually as per
the Use Agreement between the town and the FS Historical Society
as tenants of the Creole House.

Reading of Communications.
Ms. Danette Aydell, of French Settlement, addressed the Mayor
and Board of Aldermen about a support group called Compassionate
Friends. She plans to start a Chapter in the French Settlement
area and is currently searching for a place to hold the monthly
meetings. Possible locations were mentioned with the Mayor and
Board of Aldermen agreeing to assist in the search.

Police Report.
Chief Harry Brignac read the police report for the month of January,
2009. 24 traffic citations were issued for January's court date,
3 accidents reported, 28 private or confidential calls, 7 trips
to Livingston, 4 for booking prisoners, 3 for court or subpoena.
The monthly mileage for unit 1 was 496.0 with 50.5 gallons of
gas used. For unit 2, the mileage was 1673.0 with 132.4 gallons
of gas used. For unit 3, the mileage was 323.0 with 45.4 gallons
of gas used.
Alderman Guitrau stated that he had been doing research into the
problem for police officers in regard to illegal immigrants. Chief
Brignac, the Mayor and Board of Aldermen discussed the need for
considering a Program which trains officers in requesting citizenship
and how to correctly contact ICE. Due to the difficulty communicating
in Spanish, Chief Brignac stated that there is a program that
is being used by the surrounding police departments that teaches
Spanish in a few weeks. He would like to look into this program
because most of the Hispanic people that he stops do not understand
English, and he doesn't speak Spanish.
Old Business:
LGAP update 2007/2008
The mayor recently applied for the final $5000.00 reimbursement
payment of the $25,000 grant.
State Appropriation Update:
It has come to the attention of the Mayor that for proper drainage
our new storage building will need gutters to direct the water
towards the side ditch. This will not be included in the state
contract and will need to be paid with local agency funds. A motion
to purchase the gutters at the cost of $1,100 for the new storage
building was made by Alderman Miller and seconded by Alderman
Guitrau. A yea and a nay vote was called for and resulted as follows:

Road Report:
The street light at the intersection of Hwy. 16 and Anatole Lane
was repaired. The street light at Goodtimes Road was reported.
The street light at the intersections of Hwy. 16 and Hwy. 42 was
reported, and also at Hwy.16 and Hwy. 444.
Census Report:
The population report for 2008 is 989. The Mayor explained that
this is not a door to door count. It is partially based on utility
meter counts and is not a decennial count, which is more accurate.
Years ago the village's estimated population was 989 and then
after the decennial count it was said to be only 942 in population.
The decennial census paperwork has already begun for the year
2010 and the village is participating. The mayor will submit the
initial paperwork before the March 1, 2009 deadline.
Charter Communication:
Charter Communication is raising its price on the Basic package.
New Business:
Emergency Preparedness Discussion:
Mayor Guitrau asked for volunteers to help out during times of
emergency. This will be discussed in detail at a later date. She
also would like to set up a specific meeting time and date so
that the Chief of Police, and the Fire Chief may attend.
Livingston Parish Mayor's Association Update:
Mayor Laura Savoy, of Port Vincent, hosted the LP Mayor's Association
meeting on January 23, 2009. It was the first meeting to be held
in over a year with Mayors Savoy, Durbin, Font, Guitrau and Martin
in attendance. The next meeting will held in Walker with Mayor
Font as host.
US Army Corps of Engineers Meeting Update:
The U.S. Army Corps of Engineers will hold a meeting at the French
Settlement High School cafeteria on February 12, 2009, 6 pm to
9 pm to discuss plans to open up sections of the Amite River Diversion
Canal in order to allow fresh water into the marshes.
2nd FS Newsletter Distributed
The 2nd French Settlement Newsletter went out last week to all
residents.

Police Report:
Chief Harry Brignac read the police report for the month of February,
2009. 67 traffic citations were issued for January's court date,

The monthly mileage for unit 1 was 606.0 with 50.6 gallons of
gas used. For unit 2, the mileage was 1269.0 with 103.2 gallons
of gas used. For unit 3, the mileage was 833.0 with 87.0 gallons
of gas used.
Chief Harry Brignac stated that the LA State Police did a safety
check point in French Settlement. He reported one drug arrest
was made at the French Settlement High School.
Old Business:
" LGAP 2007-2008 Update: The final paper work on this grant
has been submitted.
" LGAP 2008-2009 Update: None
" BR Loop Update: A public meeting is scheduled for the 25th
of March in Denham
Springs on Eden Church Road, 5:00 to 8:00 pm.
" US Army Corps of Engineers Meeting Update:
Mayor Guitrau attended this meeting. The USACE is proposing to
open up sections of
Amite River Diversion Canal, which would allow fresh water go
into the marshy swamp
area. This requires funding, more meetings, and public input etc.,
which may take years
to accomplish.
" Emergency Preparedness Discussion:
The Mayor and Board of Aldermen agreed to send a letter to all
French Settlement
residents requesting volunteers to serve as emergency liaisons
for their road or area. This
will be discussed further at the April or May regular meeting.
" State Appropriation Update: Construction on the storage
building should begin soon, and all work must be completed by
June 30, 2009.
" Grounds Report: Upkeep of the municipal grounds begins
in March. The pavilion was rented for a fund-raiser on March 7th,
and hundreds of people attended. The mayor thanked the community
for the large turnout at the fundraiser for the Sharie Matherne
York family.
" Road Report: The mayor stated that striping is not available
on recently blacktopped roads so she requested that reflectors
be placed down the middle of the road on Aydell Lane. She is also
requesting this to be done on other high-traffic roads throughout
French Settlement.
New Business:
" Proclamation 1 of 2009 (declared April as Flood Awareness
Month) On April 7, 2009 a flood awareness public meeting will
be held at the Galvez Public Library at 6:30 p.m.
" On March 5, 2009, the Livingston Parish Mayors signed a
Proclamation declaring Zero Tolerance on Domestic Abuse). The
hotline phone number for victims of domestic abuse is (225) 665-9100

session convened.

Reading of Communication:
" Since Charter Communications filed a form of bankruptcy,
they are requiring the Board to adopt a new franchise agreement
by Ordinance so that the Village may continue to receive franchise
money.
" The Sundance channel will no longer be carried by EATEL.
Police Report:
Mayor Guitrau asked the Board of Aldermen to approve expending
$608.00 for the purchase of two chain saws for use after a storm
to clear trees off the roads in the Village.
A motion was made by Alderman Miller and seconded by Alderman
Newell to purchase two chain saws for a total of $608.00, as requested.

" Chief Harry Brignac read the police report for the month
of March. 50 citations were issued, 2 accident reports, 29 private
or confidential calls, 5 trips to Livingston, 3 for booking prisoners,
2 for court or subpoena. The monthly mileage for unit 1 was 525.0
with 69.4 gallons of gas used. For unit 2, the mileage was 1584.0
with 149.6 gallons of gas used. For unit 3, the mileage was 758.0
with 53.9 gallons of gas used.
" A Homeland Security training session is scheduled for April
27th at the LPSO firing range.
" Mayor Guitrau stated that she is considering applying for
a new grant to purchase two new police units. Alderman Miller
asked if this could be used to purchase a boat for search and
rescue operations, and Chief Brignac said he would ask but that
they are looking into other sources of funding to purchase a boat
for rescue etc.

Grounds Report:
" Easter Egg Hunt:
It was brought to the Mayor and Board of Aldermen's attention
that the grounds had been used on April 4th in order to hold an
Easter egg hunt for the community. Upon discussion, the mayor
said that when she first saw the flyer that was sent out to all
school children inviting them to this function behind the town
hall, she immediately contacted the town clerk to see if any other
function was scheduled for the grounds that day. She then contacted
the FS Historical Society President Kim Aydell and was informed
that the egg hunt was to be on Steve Brignac's back field, which
is property across the fence from the pavilion and the pavilion
would not be used. However, the Mayor and Board of Aldermen later
learned that the municipal grounds were also used that day for
the egg hunt. This raised the concern of liability and who would
be sued if someone was injured during this function, since the
grounds was used without authorization through a rental agreement.
They agree it is a good function for the children, but in the
future to avoid conflicts with other renters, and to protect the
town against possible lawsuits, the grounds must be booked in
advance for any functions. They stressed that the use of the grounds
are part of the pavilion rental agreement. When someone books
the pavilion, they have full access to the grounds, and that free
use of the grounds is not included in the Lease Agreement between
the town and the FS Historical Society. The Board of Aldermen
requested that the mayor notify the FS Historical Society to avoid
future problems of this sort.
Road Report: Mayor Guitrau stated that the street light at La.
Hwy. 16 and Perrilloux Lane is still out, and requested that the
Clerk report it again to Entergy.
State Appropriation Update: Mayor Guitrau reported that construction
has started on the town's metal storage building, and she hopes
it will be completed before the June 30th deadline so she can
submit all the final paperwork to the state.
Emergency Preparedness Discussion: Only a few people have responded
to the request for volunteers. The Mayor will set up a meeting
with Fire Chief Alan Guitreau, and Police Chief Harry Brignac.
New Business:
Legislative Update: Mayor Guitrau attended Mayor's Day in Gonzales.
The LMA announced several bills that may be of concern to some
municipalities including one that proposes the setting of term
limits for all elected officials. She encouraged all to follow
and be active in the upcoming legislative session.

The Board of Aldermen of the Village of French Settlement met
at the Municipal Building on the 13th day of May in regular session
convened.

Police report:
Chief Harry Brignac read the police report for the month of April.
55 citations were issued, 1 accident reported, 26 private or confidential
calls, 9 trips to Livingston, 6 for booking prisoners, 3 for court
or subpoena. The monthly mileage for unit 1 was 578.0 with 46.9
gallons of gas used. For unit 2, the mileage was 1551.0 with 133.2
gallons of gas used. For unit 3, the mileage was 582.0 with 64.3
gallons of gas used.
May 8, 2009 was the last day of school for French Settlement High
School seniors. After the parade, the FSHS Principal, observed
a vehicle without a parking permit, and while looking to see who
owned the vehicle he observed a gun. At that time, Chief Brignac
was notified and both schools were locked down. Chief Brignac
then followed all necessary procedures, and said that the "Procedure"
worked very well, everyone did just as planned, from the students
to the teachers, to every officer and agency that responded.
Old Business:
" Grounds Report:
Ms. Kim Aydell, President of the FS Historical Society, stated
that they had recently discovered that the Creole House has roof/chimney
damage from Hurricane Gustav. The estimated damage is $800. Mayor
Guitrau said that the insurance has a $5000.00 deductable; FEMA
only accepts damages over $1000.00. It was requested that when
the FS Historical Society hires someone to do any work/repairs
to the Creole House to make certain the person or company is insured
and bonded. It was mentioned that the pecan tree on the property
in front of the pavilion may be dead. The tree will be checked
and removed if necessary. Ms. Aydell stated that the FS Historical
Society would like to get a new sign and have permission to place
it out front. This request was discussed and it was agreed that
before allowing another sign to be placed out front, the mayor
would be more than willing to place any digital notification such
as days and hours the museum is open, the day the Creole Festival
is held etc., on the town's digital sign. It was also noted that
the word MUSEUM with an arrow pointing to the Creole House in
permanent white, vinyl lettering was already on both sides of
the lower part of the digital sign. Ms. Aydell mentioned that
someone had recently put watermelon on the breezeway of the museum.
This was discussed but without knowing when it was done or who
was responsible, it would be impossible to do anything about it.
" Road Report:
LA DOTD replaced the grating on the south Amite River Bridge on
La. Hwy 16.
" Emergency Preparedness Discussion:
FS Assistant Chief of Police Lawrence Callender is helping to
plan a ribbon cutting ceremony for the town's new storage facility,
and will schedule a presentation on emergency preparedness on
the same day.
" State Appropriation Update:
The construction of the storage facility is near completion. Limestone
will be ordered to place at the entrance.
New Business.
" Proposed Ordinance No. 1 of 2009 (Charter Cable Franchise)
was introduced by Alderman Newell. A public hearing is scheduled
for June 10, 2009 at 7 p.m. during the next regular meeting.
" Declare Surplus Property/Donation of Property:
A motion was made by Alderman Miller and seconded by Alderman
Guitrau to declare the town's old shed as surplus property and
to donate it to the French Settlement Volunteer Fire Department.

" FSWC Rate Increase Request:
The FS Water Company seeks an increase in its rates in the amount
of $160,073 representing a 16.32% increase in overall increase
in revenues. The case file history for this proceeding indicates
that notice of the requested increase has been published in the
Commission's Official Bulletin and in parish journals in which
the company operates. At the conference, the Company's representatives
advised that the Company last received a rate increase in January,
2006, based on a 2004 test year, and that, since that time the
Company has made $800,000 worth of improvements to its systems,
all of which are in service. The Company representatives also
advised that the Company operates sixteen separate water systems
and has 3850 total customers.
The parties agreed to the following schedule:
November 19, 2009 The Staff will file its report and recommendations
with regard to the application.
November 24, 2009 The Applicant may file a response to the Staff's
report, detailing areas of disagreement.
December 4, 2009 Hearing on the merits. The hearing will be convened
at 10:00 A.M. in the 11th Floor Hearing Room, Galvez Building,
602 North Fifth Street, Baton Rouge, Louisiana.

Chief Brignac also stated that the old storage shed is empty and

Mobile Home/Camper Trailer Update: As of today, on Milton Drive,
there are two out of seven camper trailers remaining illegally.
This is still in litigation.
Emergency Preparedness Discussion: This meeting will be held on
June 27, 2009, 10:00 a.m. to 12:00 p.m. WAFB, Chief Meteorologist
Jay Grymes will be the guest speaker. Representative M.J. "Mert"
Smiley will be present to dedicate the new storage building.

Newell to purchase refreshments for the Emergency Preparedness

JAG Award Update: The village was awarded $49,298.00 to purchase
2 police units. The 2006 Charger, fully equipped, will be placed
for bid to law enforcement agents. Chief Brignac requested $10,000.00

unit will go towards reimbursing the $10,000.

2008 Compilation Report: A letter from Postlethwaite & Netterville
(P&N) summarizes there were no violations, and the village

Digital Sign Discussion:
As the village's insurance has a $5,000 deductible on the $15,000
digital sign (originally purchased with a grant), the village
will need to cover the cost of repairs totaling $3800.00. A motion
was made by Alderman Miller and seconded by Alderman Guitrau to
repair/rebuild (including software) the digital sign at a cost

Mayor Guitrau stated that she is concerned about the main drainage

Capital Region Planning Commission (CRPC) Update: The following
was omitted from the Minutes of June 2009 in error: The Mayor
and Board of Aldermen discussed that since the village is a member
of the CRPC, the mayor is considered a commissioner of the organization
due to the way the CRPC bylaws are written. The motion was made
by Alderman Miller and seconded by Alderman Guitrau to withdraw
membership to Capital Region Planning Commission. A yea and a
nay was called for and resulted as follows:

Discussed the recent car-content burglaries in the French Settlement

A security light is out by the municipal pavilion but will be
repaired soon. Perrilloux Lane's street light has been repaired
by Entergy.
LMA Convention: Mayor Guitrau stated that the LMA convention
was August 6-8th. Alderman Newell, Chief Harry Brignac and Clerk
Monte Ferguson attended, and found it very informative.
LGAP Update: Mayor Guitrau reported that she applied for a $25,000
grant and the village has been awarded $11,400.00, instead, which
is understandable given the state's current financial condition.
This is going toward municipal pavilion renovation.
Digital Sign Update:
The new municipal display digital sign has been installed. The
initial sign was purchased with USDA grant funds, and was destroyed
by fire a few months ago.
JAG (Grant) Update:
Chief Brignac stated the police units being purchased through
JAG grant funds have been ordered. The oldest police unit will
be sold in order to fully equip the new units.
New Business:
Act 122 Line Item Appropriation:
Mayor Guitrau reported that the village has been approved for
10,000.00 in state appropriations. At the request of the Board
of Aldermen, it is agreed to purchase a basic rescue boat with
a power motor and trailer. In the past, the village had to borrow
boats in order to reach people in flooded areas.

1 was 595.0 with 68.8 gallons of gas used. For unit 2, the mileage

" Chief Brignac stated that the police department applied
for a JAG grant to purchase two fully equipped police units. The
police department will receive $49,298.00 towards this purchase.
Mayor Guitrau stated that the last few police units were purchased
with grant funds.
" Reminded residents to secure their property. Recently,
a trailer which was loaded with lumber was taken from a home in
French Settlement.
" Discussed the recent unlicensed peddlers going door to
door in French Settlement.

Grounds Report: The water-line leak by the pavilion restroom
was repaired. A broken security light near the museum was found
to be located on a rotten pole so it was replaced and moved to
a more secure area.
LGAP 2008-2009 (Grant Update) The $11,400.00 grant is going to
be used for renovations of the Municipal Pavilion. Every effort
is being made for the renovations to be completed before the Creole
Festival.
LGAP 2009-2010 (Grant Update) Resolution No.1 of 2009 was read
by Alderman Newell. The mayor began the application process to
request funding for an outside addition to the storage building,
clearing of drainage ditches and fence lines, etc. A motion to
adopt Resolution No. 1 of 2009 as presented was offered by Alderman
Newell and seconded by Alderman Miller. A yea and a nay vote was

Sunday, October 18, 2009 from 10:00 am to 5:00 pm. There will
be crafts, face painting, live music, food, etc.
c. CRS Update: Mayor Guitrau stated that remaining in this program
and submitting this annual report is done for the purpose of saving
the people of French Settlement 5% on their flood insurance. The
deadline to submit the paperwork is October 1, 2009.

rain the driveway to the pavilion is in need of a load of limestone
especially with the upcoming Creole Festival.
Old Business:
LGAP 2008-2009: Mayor Guitrau stated that Mr. David Stitt is doing
a fine job in renovating the pavilion; the pavilion kitchen is
almost complete, except for a few remaining items. Most of the
work should be completed prior to the Creole Festival. Once all
invoices are received, a request for reimbursement will be made.
LGAP 2009-2010: This request for funds totaling $25,000 is for
construction of a drop structure that will be attached to the
new storage building. The mayor reported that she completed and
submitted the application on time.
State Appropriations Update: Mayor Guitrau reported that she completed
the required paperwork to the State for the purchase of a rescue
boat, motor and trailer. The village has not received but was
awarded $10,000 towards capital improvements.
JAG Grant Update: Assistant Police Chief Lawrence Callender presented
an update on the status of this grant which is being used to purchase
2 police units.
Creole Festival Update: Kim Aydell, President of the French Settlement
Historical Society, spoke of the upcoming October 18, 2009 Creole
Festival. There will be several rural life demonstrations, games,
food and entertainment.
CRS Update: Mayor Guitrau submitted the annual paperwork which
is required in order to keep the 5% discount on village resident's
flood insurance policies.

The Mayor and Board of Aldermen of the Village of French Settlement
met at the Municipal Building on the 11th day of November at 7
p.m. in regular session convened.
The meeting was called to order by Mayor Toni Guitrau with the
following members present:

A prayer was offered by Alderman Miller, and the Pledge of Allegiance
was lead by local Veterans, Mr. Jack Watson, Mr. A.R. Matherne
and Chief Harry Brignac.
Alderman Guitrau read Resolution No. 2 of 2009. This Resolution
is to recognize and honor all U.S. Veterans. Veterans in attendance
received a copy of the resolution.
The motion to adopt Resolution No. 2 of 2009 was made by Alderman
Miller and seconded by Alderman Guitrau. A yea and a nay vote
was called for and resulted as follows:

Adoption of Minutes:
The motion to adopt the minutes and statement of finances for
the regular meeting of October 09, 2009 was made by Alderman Miller

Police Report:
Chief Harry Brignac read the police report for the month of October.
23 traffic citations were issued 2 accident reports, 21 private
or confidential calls, and 6 trips to Livingston, 4 for booking
prisoners, 2 for court or subpoena. The monthly mileage for unit
1 was 448.0 with 34.6 gallons of gas used. For unit 3 the mileage
was 2093.0 with 194.3 gallon of gas used.

Old Business:
a. LGAP 2008-2009: The mayor sent in a request for and received
reimbursement of $8,600. A request for the remaining $2800 balance
will be made once all work is completed.
b. LGAP 2009-2010: This grant is for an additional secure storage
area on the side of the municipal storage building to house the
village's rescue boat. The rescue boat will be purchased through
state appropriations. This grant, depending on funding, may also
be used to improve drainage around the municipal building grounds.
c. JAG Grant: This grant is used to purchase two new vehicles
for the FS Police Department. An audit was performed, and the
village should receive the balance of $5,000.00 soon.
d. State Appropriation: Mayor Guitrau stated this is the $10,000
with which the Board of Aldermen agreed to purchase a new rescue
boat, trailer and motor.
e. Creole Festival Report: Mr. A.R. Matherne reported that the
festival went well. It was noted that it was appreciated that
Alderman Newell drove the shuttle bus back and forth between the
school and town hall.
f. CRS Report: The mayor received notice that the village is in
compliance with the NFIP and therefore village residents will
continue to receive a 5% discount on flood insurance for another
year.
g. Grounds Report: None
New Business.
The following Ordinances were proposed:
a. Proposed Ordinance No. 4 of 2009 (To amend the Budget of 2009)
) was
introduced by Alderman Guitrau. Miller
b. Proposed Ordinance No.5 of 2009 (To propose the Budget of
2010) was
introduced by Alderman Guitrau. Miller
Public hearings for Ordinances No. 4 and 5 of 2009 will be held
during the regular meeting of December 9, 2009, at 7 pm.
c. The French Settlement Volunteer Fire Department Christmas
Parade is being
held on December 19th, at 12:00 p.m. with rain out date December
20th at 2:00
p.m.
d. Environmental Grant: The mayor submitted an environmental grant
requesting
approximately $33.900. At a meeting called by Parish President
Grimmer, the
mayor learned that this amount would be available to the Village
of French
Settlement if applied for by November 16, 2009. If not applied
for, the funds
would go to another municipality within the parish. New energy
efficient air
conditioning and heating systems, along with low-flush toilets
for the town hall
and outside restrooms were requested in the application.
e. Recreational Grant: The mayor met with Mr. Callender to discuss
options for
applying, through a recreation grant, for a walking trail, playground
equipment,
fountain, grills, etc. This would be a big asset to the municipal
grounds as the
mayor mentioned that for a few years she and the Board of Aldermen
were
requested by residents to consider providing a walking trail or
track on
municipal grounds, along with playground equipment. The mayor
and Board
discussed the benefits a walking trail would have to residents
of the village,
while at the same time providing a safe area for young children
to play. Also,
mentioned was the possibility of extending the walkway partially
so that it
would be overlooking the swamp area. As the pavilion and grounds
are
sometimes rented, the area would be closed to the public on such
occasions.
As there was no further business to discuss, a motion to adjourn

Police Dept. Report
Chief Harry Brignac read the police report for the month of November.

with 69.0 gallons of gas used. For unit 2, the mileage was 2093.0

Chief Brignac reported that the rescue boat has been ordered;
it was purchased with state appropriations. The 2 new police units
are being installed with police equipment. The Independence Police
Department purchased the 2006 police unit for $13,500. They were
the only bidder.
Old Business.
a. Grounds Report: None
b. Road Report: Street signs which need repair or replacement
are Highwater Road, and Matherne Lane. The street signs and a
stop sign have been ordered.
c. 11th Annual Fire Department Christmas Parade: The parade will
be held Saturday,
December 19, 2009 beginning at noon with rain-out day being December
20, 2009 at
2:00 pm.
d. Update on LGAP 2008-2009, LGAP 2009-2010, JAG GRANT, State
Appropriation, Environmental Grant, Recreational Grant: The Mayor
reported
collecting in grants and appropriations as follows: federal -
$49,298, state -
$53,832.00 for a total of $103,130.00. This funding went towards
building storage
facility; purchasing a rescue boat, trailer, and motor; 2 new
police units and
renovations to the pavilion. The mayor stated that it took a lot
of work and long
hours to reach this goal; she thanked Assistant Chief of Police
Lawrence Callender
for his assistance. Mr. Callender will continue to do the quarterly
reports
for the JAG Grant and he is also working on the recreational park
and trail grants.
The public is very much in favor of a public park and trail. The
LGAP 2009/10
grant has approximately $2738.00 remaining to spend; these funds
will go toward
renovating the pavilion kitchen area.
New Business
The motion to approve Postlewaite and Netterville, CPA to perform
the 2009 audit for $1800.00 was made by Alderman Miller and seconded
by Alderman Guitrau. A yea and a nay vote was called for and resulted
as follows:
